Both parents are responsible for supporting the children — whether that means providing a residence or paying child support. Child support is determined by a number of factors.

  • What determines child support? The factors include the amount of time each parent spends with the child (visitation, shared custody), the income of each parent, and additional expenses such as daycare costs, education expenses, medical needs, health insurance. The judge has limited discretion over child support. It is determined by the New Mexico child support formula.
  • What if there are questions about the numbers? Is one parent failing to disclose all income? Is a parent capable of earning an income but chooses not to? Through discovery and other means, we will help you make sure there is no hidden income and that the numbers are accurate and child support is fair.
  • Child support is not an option: When there are minor children, the non-custodial parent must pay child support.
